Designation

The company Thais Calles Fort, sole proprietorship, which brand is Doc’Langues, is a training organization, whose headquarters is located at 6 rue Torte 34660 Cournonterral, France.  Registered under the SIRET n. 52137814100027, represented by Thais Calles Fort as its manager.

Purpose and scope

These General Terms and Conditions determine the conditions applicable to training services performed by the company Doc’Langues on behalf of a client. Any training order with the company implies the client’s unreserved acceptance of these General Terms and Conditions. These conditions prevail over any other client document.

Quote and certificate

Doc’Langues undertakes to provide a quote to the client. The latter is required to return to the company a completed, dated, signed, and stamped copy, with the mention “Approved”. A certificate of attendance or completion of training will be provided.

Price and payment terms

Training prices are indicated in euros, all taxes included. Doc’Langues certifies that it is exempt from VAT. Payment is to be made after the service is performed, upon receipt of the invoice, in cash; in the case of installment payments, invoices are sent according to the services performed. Payment of invoices can be made by bank transfer, PayPal or credit/debit card.

For international clients, payments will only be accepted in euros. Bank charges related to international transactions are the responsibility of the client. International bank details (IBAN and BIC) will be provided upon request to facilitate international transfers.

Coverage

If the client benefits from funding by an Approved Joint Collection Agency (OPCA), they must request coverage before the start of the service. The client is required to provide the funding agreement at the time of registration. In the event that the company Doc’Langues does not receive the OPCA coverage on the first day of training, the full training costs will be billed to the client.

For international clients with access to training funding in their country of origin, it is their responsibility to inquire about the conditions and possibilities of coverage by their national organizations. Doc’Langues can provide necessary documents in French to facilitate these procedures.

Conditions for postponement and cancellation of a training session

Cancellation of a training session is possible, provided it is done at least 10 calendar days before the scheduled day and time. Any cancellation must be notified by email to contact@doclangues.fr. In case of cancellation between 4 and 10 working days before the training date, the client is required to pay a cancellation penalty of 20% of the initial total cost of the training. In case of cancellation less than 3 working days before the start of the training, a cancellation penalty corresponding to 30% of the initial total cost will be billed to the client.

The request to postpone participation in a training can be made by the client, provided they send a written request to the training organization within 10 days before the training date.

In case of non-performance of its obligations due to a fortuitous event or force majeure, Doc’Langues cannot be held responsible towards its clients. The latter will be informed by email.

Time zone and scheduling

For all online sessions and scheduling purposes, the reference time zone will be Central European Time (CET/CEST). Clients are responsible for converting times to their local time zone. Both parties agree to clearly communicate their respective time zones when scheduling sessions to avoid any confusion.

Training program

If deemed necessary, the instructor may modify the content of the training according to the group dynamics or the level of the participants. The content of the programs appearing on the presentation sheets is thus provided only as an indication.

Intellectual property and copyright

Training materials, whatever their form (paper, digital, electronic…), are protected by intellectual property and copyright. Their reproduction, partial or total, cannot be carried out without the express agreement of the company. The client agrees not to use, transmit, or reproduce all or part of these documents for the purpose of organizing or conducting training.

Information technology, freedoms, and data protection

In accordance with the General Data Protection Regulation (GDPR) 2016/679 of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, the company implements a processing of personal data whose purpose is the sale of products and services defined in this contract. The client is informed of the following elements:

  • The identity and contact details of the data controller and, where applicable, the controller’s representative: as indicated at the top of these T&Cs;
  • The purpose of data processing: contractual execution
  • Personal information communicated by the client to Doc’Langues is useful for processing the registration, contractual execution of the training action as well as for the constitution of a client file linked to the conduct of the training action; the information collected is: surname, first name, address, personal or professional email, identifier, target language, tests, positioning or information sheet, educational activities carried out, types of activities, duration, certification, certificates, attendance sheets, convocations, and any other document attesting to the completion of the training action.
  • The recipients or categories of recipients of personal data, if they exist: the data controller, the services in charge of IT security, the subcontractors involved in the training action, as well as any authority legally authorized to access the personal data in question.
  • International data transfers: Personal data of international clients may be processed within the European Union. No transfer outside the EU is planned, unless it is necessary for the execution of the contract (for example, the use of online learning platforms). In this case, appropriate safeguards will be put in place in accordance with the GDPR.
  • The retention period for data for a training action is 10 years.
  • According to the French law on “information technology and freedoms” of January 6, 1978, and the GDPR, the client has the right to request from the data controller access to personal data, rectification or erasure of such data, or a limitation, opposition or portability of the processing relating to the data subject. – To exercise this right, the client can contact the data controller at contact@doclangues.fr. The data subject also has the right to lodge a complaint with a supervisory authority such as the CNIL in France – the information requested during the order is necessary for the establishment of quotes, invoices, and the execution of the training action. No automated decision-making or profiling is implemented through this process.

Dispute — Consumer mediation

In case of a dispute between the Client and the company, they will endeavor to resolve it amicably (the Client will address a written complaint to the Customer Relations Service of the Manufacturer or that of the Seller).

In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer Client within the meaning of Article L.133-4 of the Consumer Code has the possibility to refer, free of charge, if a disagreement persists, to the competent mediator registered on the list of mediators established by the Commission for the evaluation and control of consumer mediation pursuant to Article L.615-1 of the Consumer Code, namely: The Professional Mediation Society www.mediateur-consommation-smp.fr  Alteritae  5, rue Salvaing 12000 Rodez

 

Applicable law and jurisdiction

These General Terms and Conditions are governed by French law. In case of a dispute arising between the company Doc’Langues and the client, an amicable solution will be preferred. Failing this, the case will be brought before the competent court in the city of Montpellier, France.

Language of the contract

These General Terms and Conditions are written in French and may be translated into other languages to facilitate understanding for international clients. In case of discrepancy between the French version and any translation, the French version shall prevail.

All communications related to this contract can be conducted in French, English, or Spanish, according to the client’s preference.
